Old Lease Unitization Clause

    We have 1956 lease with unitization clause language "granted right to pool and unitize Onondaga, Oriskany or deeper formations under all or any part of land etc."   Current lessee is producing gas with old wells.  Any suggestions on how to handle lease with regards to Marcellus?

    The Marcellus in Middle Devonian whereas the Onondaga and Oriskany are part of the Lower Devonian and below the Marcellus.  In my opinion the lease doesn't apply to the Marcellus.

    My lawyer seems to think it does just that the clause needs to be amended but I am not sure he is right.  I don't know if we are stuck with the present lessee or if I can shop it around and who to go to for some advice.  Am in Southwestern PA area.
